Terms of sale

ARTICLE 1: OBJECT

These terms of sale are intended to define the contractual relationship between De Pino and the buyer and the conditions applicable to any purchase made through the website depino.fr.

The acquisition of a product through this site implies acceptance without reservation by the buyer of these conditions of sale which the buyer acknowledges having read prior to his order.

Before any transaction, the buyer declares to have full legal capacity, allowing him to engage under these terms and conditions of sale.

De Pino retains the right to change these terms of sale at any time, to comply with any new regulations or improve the use of its site. Therefore, the conditions applicable will be those in effect at the date of the order by the buyer.

ARTICLE 3: ESSENTIAL CHARACTERISTICS OF THE PROPOSED GOODS

The characteristics of the various products offered for sale are presented in each of the descriptions, in the section “Shop” of our site. Each product is presented in the form of a description of its main technical characteristics. The photographs are as faithful as possible but do not constitute a contractual document between the purchaser and De Pino.

In accordance with Article L.411-1 of the Consumer Code (former Article L.212-1), the products comply with the requirements of French law in force relating to the safety and health of persons, loyalty commercial transactions and the protection of consumers at the time of their placing on the market.

The products are offered for sale until the stock is exhausted. De Pino only sells creations that constitute unique pieces or limited series. As a result, some items may become unavailable.

Apart from the reimbursement of the price of the unavailable product, the seller is not liable for any costs related to the cancellation of a order, unless the breach of the contract is personally attributable to him.

The “Shop” section of our site indicates, for each piece, the prices in euros, all taxes included, excluding shipping costs. The shipping costs appear on the screen at the end of the selection of different products by the customer. De Pino reserves the right to change prices at any time but the products ordered are charged at the price in effect at the placing of the order.

ARTICLE 4: RATES

The prices listed on the product sheets are prices in Euros (€) inclusive of all taxes (VAT), taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. De Pino reserves the right to modify its prices at any time, provided however that the price listed in the catalog on the day of the order will be the only applicable to the buyer. The prices indicated do not include the delivery costs, invoiced in addition to the price of the products bought according to the total amount of the order and the geographical zone of delivery (France / Other).

ARTICLE 5: ORDER AND TERMS OF PAYMENT

The customer validates his order when he activates the “Order” link at the bottom of the page “Your order” after having accepted these conditions of sale. Before this validation, it is systematically proposed to the customer to check each element of his order; he can thus correct his possible errors.

De Pino offers the buyer to order and pay for its products in several stages, with 2 payment options to choose from: Debit or Credit card (Visa, Mastercard, Amex) /  Apple Pay.

The confirmation of an order implies acceptance of these conditions of sale, the acknowledgment of having understood these terms and the waiver of its own terms of purchase. All data provided and the recorded confirmation will be considered proof of the transaction. If the buyer has an e-mail address and if he has entered it on his order form, De Pino will communicate to him by e-mail the confirmation of the receipt of his order.

Any modification of order by the consumer after confirmation of his order is subject to the acceptance of De Pino.

De Pino reserves the right to refuse any order for legitimate reasons and more particularly if the quantities of products ordered are abnormally high for buyers who are consumers.

ARTICLE 6: RESERVATION OF PROPERTY

De Pino returns full ownership of the products sold until the full collection of the purchase price, in principal, charges and taxes included.

ARTICLE 7: RETRACTATION

Under Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise his right of withdrawal and thus return the product for exchange or refund without penalty, except for the return costs.

Returns

Items unworn, unwashed and still tagged may be returned after acceptance by De Pino. The cost of the item(s) and the original shipping fees will be returned to the customer after receipt and validation by De Pino.

ARTICLE 8: DELIVERY

Deliveries are made to the address indicated on the order form which can only be in the agreed geographical area. Orders are made by La Poste via Colissimo, delivery service with tracking, delivery without signature. Delivery times are only indicative. De Pino may provide by e-mail to the buyer the tracking number of his package. The item(s) is delivered to his home by his postman. In case of absence of the buyer, he will receive a notice of passage of his postman, which allows him to withdraw the products ordered at the nearest post office, for a period indicated by the postal services. Transport risks are the responsibility of the purchaser from the moment the articles leave the premises of De Pino, including the condition of the packaging of the goods and its contents upon delivery. In case of damage during transport, any protest must be made to the carrier within three days of delivery.

ARTICLE 9: GUARANTEE

All products supplied by De Pino benefit from the legal guarantee provided by articles 1641 and following of the Civil Code. In case of non-compliance of a product sold, it may be returned to De Pino who will accept return, exchange or refund. All claims, requests for exchange or refund must be made by email to contact@depino.fr, within 14 days of delivery.

ARTICLE 10: LIABILITY

The articles proposed are in accordance with current French legislation in force. De Pino can not be held responsible in case of non-compliance with the legislation of the country where the article is delivered. It is your responsibility to check with the local authorities the possibilities of importing or using the items you plan to order.

In the process of distance selling, De Pino is held only by an obligation of means. It can not be held responsible for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, break of the service, or other involuntary problems.

ARTICLE 11: INTELLECTUAL PROPERTY

All elements of the site depino.fr are and remain the intellectual and exclusive property of De Pino. De Pino reserves worldwide rights to all text and images and intellectual property presented on the website of De Pino in perpetuity. Their reproduction, even partial, is strictly forbidden. No one is therefore authorized to reproduce, exploit, or use, in any capacity whatsoever, even partially, elements of the site whether in the form of photo, logo, visual or text without prior express and written approval by De Pino.

ARTICLE 12: PERSONAL DATA

De Pino is committed to preserving the confidentiality of the information provided by the buyer, which they are obligated to transmit for the use of certain services. All information concerning the buyer is subject to the provisions of French Law No. 78-17 of 6 January 1978. As such, the user has a right to access, modify and delete information about himself. ARTICLE 13: LAW APPLICABLE IN CASES OF DISPUTE

These general conditions are governed by French law. Any litigation or possible litigation will be the exclusive jurisdiction of the courts of Paris.
